Suppressio veri and Suggestio falsi

 From Sampath’s Desk:

Suppressio veri and Suggestio falsi

These terms are mostly used in legal parlance.

Origin of the words:  LATIN

This is a legal maxim - ‘Suppression of the truth is equivalent to the suggestion of what is false’

Pronunciation:

Suppressio veri – ஸப்ரெஷியோ வெரி (or) வேரி

Suggestio falsi  - ஸஜ்ஜெஷியோ ஃபால்ஸி

MEANING:

SUPPRESSIO VERI -  Hiding or concealing the truth - உண்மையை மறைத்தல்

SUGGESTIO FALSI :: Misrepresentation by falsehood, tell a white lie – பொய்யை மெய் போல கூறுதல், பொய்யை உண்மை என்று கூறுதல்

Both the terms are mostly used together

Example Sentences:

The contentions and averments made by the Plaintiff/Petitioner in his plaint/affidavit/petition amount to suppressio veri and suggestio falsi.

The advocate argued before the court that the petitioner ‘X’ has filed a Written Statement in the writ proceedings which suffers from suppressio veri and suggestio falsi’.

Equity must come with clean hands. But the Respondent is guilty of ‘suppressio veri and suggestio falsi’ while filing his counter-affidavit. He has not come to court with clean hands. So, he is not entitled to any indulgence by the Honourable Court.

Proverb:

மனது அறியாப் பொய் உண்டா ?

Can a mind be ignorant of its own falsehood?
